A company director who was spotted driving his van in a "jerky way" refused to give a breath sample to test for alcohol because of "Covid".
A witness says they saw Aleksandr Kolosov driving in Station Road, Long Eaton, before mounting a kerb and coming to a stop.
Southern Derbyshire Magistrates' Court heard how someone was able to flag down a British Transport Police officer who approached the 38-year-old, who at this time was slurring his words and couldn't stand unaided.
The hearing revealed how Kolosov was taken to Chesterfield police station because the breath-sample machine was broken when he first arrived at St Mary's Wharf.
At Chesterfield, the court heard he refused to give a specimen for analysis because of "Covid".
Magistrates heard how this was his "fourth similar offence" and handed him a suspended sentence for his actions.
